Seller's legal guarantee of conformity, signalling non-conform defects and guarantee interventions

1) Pursuant to and for the purposes of the European Directive 44/99 / EC and the Italian Legislative Decree no. 206/2005, all products marketed enjoy the legal guarantee of conformity provided for in articles 128 et seq. of the Consumer Code which covers any lack of conformity of the items purchased, existing at the time of delivery and which occur within 2 years of delivery. Any defects or damage caused by accidental events or by the Customer's responsibility for use of the products not compliant with their intended use, or effect of normal wear and tear, are excluded from conformity defects and, therefore, from the legal guarantee.

2) To benefit from this guarantee, the customer must report the lack of conformity with a communication addressed to the seller at info@pelletteriascalvini.it, indicating the defect and / or non-conformity found and returning the following documentation: at least n. 1 (one) photograph of the product, the order confirmation sent by the Seller and the invoice.

Unless proven otherwise, it is assumed that any lack of conformity that occurs within one year from the time the goods were delivered already existed on that date, unless this hypothesis is incompatible with the nature of the goods or with the nature of the defect. of compliance.

3) Following receipt of the communication referred to in paragraph 2 above and the related documentation, the Seller will assess the defects and non-conformities reported by the Consumer and, after having carried out the quality checks to verify the actual non-conformity of the Product.

The Customer can ask the seller, at his choice, to repair the good or replace it, free of charge in both cases, unless the requested remedy is impossible or imposes disproportionate costs on the seller.

The consumer customer has the right to a proportional reduction in the price or the termination of the sales contract, in accordance with the provisions of art. 135 bis, paragraph 4, of the Consumer Code and, in particular, if: the seller has not carried out the repair or replacement within the terms and conditions provided for by the Consumer Code, or has refused to bring the goods into conformity; if the lack of conformity is so serious as to justify the immediate price reduction or termination of the contract; if a lack of conformity occurs despite the seller's attempt to restore the conformity of the goods; if the seller has declared (or this is clear from the circumstances) that he will not proceed to restore the conformity of the goods within a reasonable period or without inconvenience.

The consumer customer has no right to terminate the contract if the lack of conformity is only minor.

For goods with digital elements, the seller undertakes to keep the consumer customer informed about the updates (including security) available, necessary in order to maintain the conformity of such goods, and to provide them for an appropriate time, taking into account the circumstances and the nature of the contract and in any case, as the case may be, if the sales contract provides for a continuous supply of the digital content or digital service over a period of time.

The seller is not responsible for any lack of conformity deriving solely from the lack of the relevant update, if the consumer does not install the updates appropriately provided within a reasonable time.

The Products must be returned by the Consumer, together with a copy of the return authorization notice, within 30 (thirty) days from the latter, to the following address: CIPLdi Scalvini M. e I. snc Via Brescia 13 -25035- Ospitaletto ( BS), Italy. The return costs for defective products or for non-compliance of the products with the order (wrong item, damaged products, etc.) will be borne by C.I.P.L. of Scalvini M. e I. snc

4) If the Seller is required to reimburse the Consumer for the price paid, the refund will be made by bank transfer or, where possible, by the same means of payment used by the Consumer when purchasing the Product. It will be the responsibility of the Consumer to communicate to the Seller, again by e-mail, the bank details to make the transfer in his favor and to ensure that the Seller is put in a position to be able to return the amount due.

5)The images and colors of the articles on the site may not fully correspond to the real colors of the products, this is due to the type of computer screen or browser used for navigation.

We would like to remind you that each product packaged in natural leather may be slightly different from another, above all the hue and nuances, compared to the presentation photograph.
