Seller's legal guarantee of conformity, signalling non-conform defects and guarantee interventions
- Pursuant to European Directive 44/99/CE and Italian Legislative Decree no. 206/2005 (Consumer Code), the Seller shall guarantee to the Consumer that the Products are free from design and material defects and that they conform to the descriptions published on the Site, for a period of 2 (two) years from the date of delivery of the Products to the Consumer. The use of any guarantee is excluded in the event of Product use and/or washing and/or cleaning that does not conform to that suitable for the Product and the instructions/warnings supplied by the Seller, as detailed on explanatory reference documentation and/or labels.
- The Consumer shall be responsible for examining the Product in the shortest time possible, under penalty of expiry of this guarantee, and for reporting any defects and non-conformity by and no later than 2 (two) months from the discovery by sending an email to the Seller's Customer Service department: firstname.lastname@example.org . The Consumer shall indicate the defect and/or non-conformity found and attach the following documentation: at least 1 (one) photograph of the Product, the order confirmation sent by the Seller and the invoice.
- Following receipt of the communication and the relevant documentation as per point 2. the Seller shall evaluate the defects and non-conformities highlighted by the Consumer. After having carried out quality controls aimed at checking Product non-conformity the Seller shall decide, under its discretion, whether to authorise the return of the Products and acknowledge such to the Consumer via email using the address provided during the Site registration process. Authorisation to return the Products shall not constitute in any way acknowledgement of fault or non-conformity. The existence of such shall be determined upon return. The Products that the Seller authorises for return must be returned by the Consumer, together with a copy of the authorisation communication, within 30 (thirty) days of the latter to the following address:C.I.P.L.di Scalvini M. e I. snc Via Giuseppe Zanardelli n. 142- 25035- Ospitaletto (BS),, Italia. The cost of returning defective Products or Products that do not conform to the order (wrong item, damaged product, etc.) shall be borne by C.I.P.L.di Scalvini M. e I. snc.
- In the event that the Seller is obliged to reimburse the Consumer, this shall be made via bank transfer or, where possible, using the same method of payment used by the Consumer to purchase the Product. It shall be the Consumer's responsibility to communicate to the Seller via email the necessary bank details for receiving such a bank transfer and to ensure that the Seller is able to return the amount owed.
